Notice of Public Hearing and Proposed Amendment to Chapter 53 of the Code of the Village of Green Island

NOTICE OF PUBLIC HEARING

The Village of Green Island will hold a public hearing on Monday, August 19, 2013 at 6:30 p.m. at the Green Island Municipal Center, 19 George Street, Green Island, NY.
The purpose of the public hearing is to consider Local Law No. 5 of 2013. A local law entitled “Amendment to Chapter 53 of the Code of the Village of Green Island.” The purpose the public hearing is to amend §53-2.1 Number of dogs and/or cats that are allowed in a dwelling unit.

Local Law No. Five of the year 2013
A local law – of entitled Amendment to Chapter 53 of the Code of the Village of Green Island as follows:
Be it enacted by the Board of Trustees of the Village of Green Island
Pursuant to the Authority conferred in Section 7-700 of Village Law of the State of New York, the Board of Trustees of the Village of Green Island hereby adopts and enacts Local Law No. 5 of 2013 as follows:

Section 1
§53-2.1 Number of dogs and/or cats.
A. No person or persons shall own, harbor, or keep more than three dogs and/or cats, that number being the total
combined number of dogs and/or cats, which are more than four months of age in any premises Containing three or fewer dwelling units, or more than one dog and/or cat more than four months of age in any dwelling unit in a
premises containing four or more dwelling units, except in pet shops, veterinary hospitals, and kennels established in accordance with the Zoning Code of the Village of Green Island.
B This section shall not apply to cats and dogs licensed in the Village of Green Island before the date of adoption of this section, and harbored at a single dwelling unit or premises, provided, however, that this exemption shall apply only to such licensed dogs and cats vaccinated for rabies and this exemption shall not allow for replacement of or additions to the number of any such dogs and cats until such time as the replacement or addition will not raise the total number of dogs and cats at a dwelling unit or premises to a number which is in violation of this section.
C Nothing in this section shall prevent an owner from further restricting the number of or prohibiting cats and/or dogs on a premises.

Section 2. This local law shall take effect upon filing with the Secretary of State of the State of New York
